Cassidy.  As I enter my 20th year as an Attorney, I continue to serve my clients in ways that leave them satisfied.   I have specialized in the areas of Family Law, Criminal Law, Estate Litigation and Personal Injury.  My staff and I welcome the opportunity to meet with you and discuss how my office can be of service to you.

Note: Recent attempts by opponents of such actions have focused on the difference between termination and suspension or modification.  Make sure you consider pleading in the alternative when seeking relief.

Criminal Law - What are your rights?  What should you do if the police want to question your son or daughter?  The answer to this question is to speak to a legal professional experienced in Criminal Law.  After my time as an Assistant District Attorney in Essex County, I have practiced in the area of criminal law for the past 18 years, handling cases from homicides down to simple assaults and OUI (drunk driving).  

Massachusetts Homestead Law   On  March 16, 2011, a new Massachusetts Homestead law went into effect. It  completely revised and  modernized Massachusetts General Laws Chapter 188, sections  1-10.  Homesteads are very inexpensive insurance. Under the new law all old Homesteads are grandfathered in so there is no need to re-exceute.  However, now both Husband and Wife can execute a Homestead.

Pre-Nuptial Agreements   Are you, a family member, especially one of your children considering getting married?    If so, they should really consider entering into a pre-nuptial agreement.   A fair agreement now will likely save them both tens of thousands in fees later on if things do not work out as planned.  While not the happiest of topics, it is like the issue of creating a will.  It recognizes the fragility of life and a professionally drafted pre-nup recognizes that, based upon statistics, marriage has a 50-50 chance of success.  The step is well advised for a young couple just starting out.  Please feel free to call me to discuss same.

Estate Planning Tip:  If you have a will and have not looked at in 5 years or so, you should pull it out and  read at it.  If it still seems fine as is it is, then it is probably ok to put it right back.  If not, then consider a new will or a codicil to the old will.  It is always the best advice to review same with a lawyer practiced in estate planning.

Child Support in Massachusetts:  All parents are responsible for the support of the children.   Usually the parent not living with the child full-time makes regular, fixed payments to the other parent. The Parent  receiving the funds can use these funds as they deem appropriate, absent court orders to the contrary.  The amount of support can be by agreement of the parties   or as may be determined by judge applying the child support guidelines.  They are available online ww.mass.gov/dor/.  Some relevant factors are the income of the parents, medical and dental insurance costs, other expenses being paid for the child's benefit. Sometimes a custodial parent will withhold visitation until they get ther support check.  The courts frown on this behavior and it should be avoided.  There is no connection between paying child support and visitation. Paying child support does not automatically entitle a person to have visitation rights with their child and failure to pay does not cancel these rights once established.   Child support stops when the child turns 18, which is typically after they have graduated from high school iand decided not to work instead of  college.  Child support can continue until age 23 if the child resides with a parent and is dependent on the parent the support, or if they are enrolled full-time in college .
